Actor Alec Baldwin is returning to court over the fatal 2021 “Rust” shooting that claimed the life of cinematographer Halyna Hutchins. The actor was not held criminally responsible in the shooting, as a judge dismissed the state’s case against him with prejudice in 2024. Police in the US have released video footage from the set of the film Rust, including of the aftermath of the fatal shooting of a cinematographer by actor Alec Baldwin. Halyna Hutchins, 42, was shot by Mr Baldwin while he rehearsed with what he believed to be a safe gun. Footage, which has no audio, released shows Baldwin dressed as a cowboy rehearsing with a gun ahead of the deadly shooting. He can be seen in stills from that video posing with the gun, and with ammo / ammunition on his costume in a scene set in a church. A clapper board with Ms Hutchins' name on it can also be seen. It's not known if the gun he is holding is the one that fired the deadly bullets. The actor, who was also a producer on the film, previously said he did not pull the trigger and had no idea how a live bullet came to be on the set near Santa Fe in the US state of New Mexico. On Friday, a judge decided that a civil case brought against the “30 Rock” actor by gaffer Serge Svetnoy would continue. The crew member alleged that he had suffered emotional distress due to the negligence of Baldwin and the “Rust” production team.

In a summary judgment ruling on Friday, Los Angeles Superior Court Judge Maurice Leiter decided that the case could proceed to trial. Rust Movie Productions and Baldwin unsuccessfully argued that they were not legally responsible for set safety. The actor has insisted that he did not know the gun was loaded with live rounds and has vehemently denied pulling the trigger.

“A reasonable jury could find that Mr. Baldwin recklessly disregarded the probability that pointing a gun in the direction of someone, with the finger on the trigger, would cause emotional distress,” the judge wrote, as per Variety.

Svetnoy was not injured in the shooting, but he did say that he felt the force of the gunshot and that he heard a loud bang in the small church where the scene was being rehearsed. Although the gaffer also sued for assault, the judge dismissed that claim, citing that there was no evidence that Baldwin ever intended to harm anyone.

Although it is possible that Baldwin and other “Rust” producers will settle their case, Baldwin will again face questions over whether or not he acted recklessly by pointing the gun at the crew while filming the scene.

“Mr. Baldwin is the last line of defense,” Svetnoy’s attorney John Upton, Svetnoy’s argued at a hearing on Friday. “Guns generally do not shoot themselves.”

The Trial Is Set For October 2026

The judge decided that Svetnoy’s claims for punitive damages, negligence, and intentional infliction of emotional distress could proceed to trial, even though Rust Movie Productions argued that the crew member’s claims should be left to the workers’ compensation system.

Leiter determined that the company had no employees and thus failed to show that workers’ compensation was available.

“We’re pleased with the court’s decision,” Upton said outside of court. “And we’ll see where it goes from here.”

Although the trial was scheduled to begin on May 26, both parties requested a lengthy continuance to pursue further discovery and discuss a possible settlement. The trial is now set for October 12.

“I’m a little concerned about this case going on and on and on when it should be coming to a resolution,” the judge said, noting that the shooting happened five years ago.

Alec Baldwin Is Looking To Retire

In mid-April, Baldwin was a guest on The Hollywood Reporter’s Awards Chatter podcast, where he discussed how the “Rust” shooting led him to want to retire.

“We had this incident, this tragedy, in New Mexico, where Halyna Hutchins was killed on the set of the film, and that was unspeakably difficult to deal with … Because of the situation in New Mexico, which was very painful, I wound up staying home a lot,” he recalled.

“I was home with my kids for three-and-a-half years — I hardly worked at all — and that’s just changing now. I’m going to go off and do a bunch of things. But I was home, and I got used to it, and I don’t want to leave my house anymore. I don’t,” he continued. “I don’t want to work anymore. I don’t. I really don’t. I want to retire and stay home with my kids.”

As The Blast previously reported, Baldwin claimed that the 2021 “Rust” shooting has taken a substantial toll on his physical and emotional health. On an episode of the podcast “Dopey: On the Dark Comedy of Drug Addiction,” the “Boss Baby” actor explained that the shooting took a serious toll on his family, friendships, and career.

“What it’s done to my health,” he said during the episode, which was published in December 2025. “I mean, if I told you what my health conditions have been since October 21st of 2021 – it’s taken at least 10 years off my life.”

Baldwin shares seven children with his wife, Hilaria Baldwin: daughters Carmen, 12, and María Lucía, 4, and Ilaria, 2, and sons Rafael, 10, Leonardo, 9, Romeo, 7, and Eduardo, 5. He is also the father of model Ireland Baldwin from his previous marriage to “Batman” actress Kim Basinger.
