Timothy Busfield’s legal fight took a dramatic turn after a New Mexico judge threw out the grand jury indictment that had put the actor and director on a path toward trial on four felony counts.

The ruling is a major victory for the “West Wing” and “Field of Dreams” star, who has repeatedly denied allegations that he inappropriately touched two young actors while working on “The Cleaning Lady.”

However, Busfield’s legal battle may not be over. The judge made it clear that prosecutors remain free to pursue the case again, leaving the 69-year-old with a significant win but no guarantee that the allegations are permanently behind him.

New Mexico District Court Judge Joseph Montaño granted Busfield’s motion to quash the indictment on October 16 after finding serious problems with how prosecutors handled the grand jury.

According to PEOPLE, Montaño found that the prosecuting attorney failed to act “in a fair and impartial manner” and improperly instructed jurors about hearing additional witnesses.

The judge concluded that the process violated statutes intended to protect the “structural integrity” of the grand jury system.

TMZ reported that the ruling also addressed claims prosecutors misrepresented whether polygraph evidence could be considered and failed to call witnesses after grand jurors asked to hear from them.

Busfield’s attorneys had sought dismissal since June, accusing the state of creating procedural obstacles that kept potentially favorable testimony from jurors.

The ruling does not amount to an acquittal. Montaño specifically left prosecutors free to bring new criminal proceedings, meaning the Bernalillo County District Attorney’s Office could seek another indictment.

The office told PEOPLE that it had received the order and was “evaluating our options to determine how we will proceed.”

Busfield had been scheduled for trial in May 2027, but that timeline now depends on prosecutors’ next move.

He pleaded not guilty in February to four counts of criminal sexual contact of a minor under 13. The charges stemmed from alleged incidents in 2022 and 2023 involving twin boys who worked on “The Cleaning Lady,” which Busfield directed.

The Associated Press noted that Busfield has consistently denied wrongdoing and described the allegations as false and revenge-motivated.

Grand Jurors Allegedly Asked Repeatedly To Hear More Witnesses

One of the most damaging findings for the prosecution involved witnesses the grand jury wanted to hear.

PEOPLE reported that eight witnesses testified at a September hearing that they had been present and willing to appear during the grand jury proceedings.

Grand jurors expressed interest in additional testimony at least three times, including asking specifically for witness Alan Caudillo.

Prosecutors allegedly told jurors that eight members first needed to agree a witness was necessary and that subpoenas had to be issued at least 36 hours in advance.

The court found that procedure was not established by law and noted that willing witnesses did not necessarily need subpoenas.

Busfield’s attorney Amanda Fayerberg characterized the state’s handling as “egregious prosecutorial misconduct.”

Prosecutors countered that Busfield’s defense had not followed the proper process for presenting favorable evidence and accused the actor of trying to steer jurors toward favorable witnesses during his own testimony.

Questions About The Evidence Had Surfaced Months Earlier

The dismissal did not come out of nowhere. When Timothy Busfield was released from jail in January, Judge David Murphy described the weight of the evidence then before him as “neutral.”

ABC News reported that Murphy pointed to defense affidavits, testimony and an independent investigation commissioned by Warner Bros. that did not corroborate the allegations.

Christina McGovern, who led that investigation, later said she found no corroborating evidence that Busfield engaged in inappropriate conduct or was ever alone with the twins on set.

The Associated Press also reported that Busfield’s lawyers emphasized that the boys initially told police he had not touched them inappropriately. The defense has argued the allegations emerged after the twins lost their roles on the series.

Even before the indictment was tossed, Busfield said the case had effectively ended his career.

As The Blast previously reported, the veteran actor told the grand jury he had been “canceled,” lost work and been dropped by his agency as the allegations spread.

His wife, “Little House on the Prairie” actress Melissa Gilbert, has remained publicly supportive.

During an April interview with Good Morning America, Gilbert called the ordeal “the most traumatizing experience of our lives” and said she was “100% confident” her husband would be exonerated.

The Blast also reported in January that Busfield was released from custody pending trial after the court declined to keep him jailed.

For now, the October ruling removes the indictment that had been hanging over Timothy Busfield for months and disrupts the path toward his scheduled 2027 trial.

Still, the legal victory has a clear limit, as prosecutors have not said the matter is finished, and the judge’s order leaves them room to start again.
