Federal prosecutors have pulled a surprise on Sean “Diddy” Combs‘ defense team in his ongoing sex crimes trial.

They revealed plans to call another person labeled “victim 5,” someone who was not named in the superseding indictment filed against the embattled music mogul.

This revelation comes after prosecutors also informed the court that they have been unable to reach one of the other witnesses in the case and are u/ncertain whether she will testify during the trial.

In today’s pre-trial hearing for Diddy’s sex crimes case, prosecutors informed Judge Arun Subramanian that they intend to call a “Victim 5” to testify against the rapper.

In the legal documents filed last month, prosecutors did not disclose the existence of this alleged victim, seemingly holding back the detail to catch Diddy’s defense team off guard.

According to TMZ, the victim, whose identity remains unknown, is expected to testify that Diddy committed an act of sexual misconduct in the past, an incident for which he is not being criminally charged in this case.

Following the revelation, Diddy’s legal team attempted to block the testimony from being presented to the jury.

However, their efforts were only partially successful, as Judge Subramanian ruled that at least some of the testimony would be allowed once the trial officially began.

Still, Diddy’s attorneys walked away with a minor win, as the judge also ruled that the alleged accuser will not be granted anonymity during the trial.

In the hearing, Diddy’s attorney, Marc Agnifilo, also hinted at how the rapper’s legal team intends to tackle the testimony of “Victim 1.”

Victim 1 is already known to be Cassandra “Cassie” Ventura, Diddy’s ex-girlfriend, who was seen being assaulted by the rapper in a viral 2016 hotel surveillance video that resurfaced shortly before his arrest.

Her testimony is said to be central to the case, including claims that she was one of the women he allegedly forced to participate in his now-infamous sex- and drug-fueled parties known as “freak offs.”

Speaking with Judge Subramanian, Agniflo said the defense “is going to take the position there was mutual violence in their relationship,” adding there was “hitting, on both sides.”

He continued, “We are absolutely going to admit to domestic violence. But at what point does it become coercive?”

As for Diddy’s jury selection, a decision on the final panel was not reached during the hearing.

According to Deadline, the process is expected to conclude early Monday morning and was only delayed due to last-minute objections and challenges from prosecutors and defense attorneys.

In total, the trial will have 12 jurors plus six alternates who will determine Diddy’s fate after what could be an eight-week trial.

Opening statements from the attorneys will also begin on Monday and are expected to set the tone for the rest of the proceedings.

In the previous pre-trial hearing, federal prosecutors revealed in court that they were unable to locate one of the witnesses, who is referred to in the indictment as “Victim 3.”

According to the Daily Mail, the witness in question is not residing in New York, where the trial is currently taking place.

This disclosure appears to have shut down what was expected to be a series of “very personal and explosive details” regarding the abuse she allegedly suffered at the hands of Diddy.

If “Victim 3” fails to testify, prosecutors may be forced to rely solely on the testimonies of Cassie, “Victim 2,” and “Victim 4.”

“Victim 2” is expected to testify about her relationship with Diddy, including how she endured “financial losses, dependency, and social isolation” that left her vulnerable to his coercion.

“Victim 4” is reportedly a former employee of the embattled music mogul whom he allegedly forced into sexual acts. The identities of Victims 2 and 4 remain unknown to the public at this time.

In this ongoing trial, Diddy is facing charges of racketeering conspiracy, two counts of sex trafficking, and two counts of transportation to engage in prostitution.

If found guilty of racketeering, he could face life in prison. A conviction for sex trafficking carries a mandatory minimum sentence of 15 years, while the transportation charges could bring an additional sentence of up to 10 years.

Despite the chances of spending the rest of his life in prison, Diddy recently rejected a plea deal that may have ensured he got a lighter sentence.
