The former “Real Housewives of Beverly Hills” star and her estranged husband are going at it with claims that she failed to file the adoption documents for their daughter, Eloise, properly.

Denise Richards and Aaron Phypers have bickered nearly every day since their divorce filing hit the headlines in July, including a recent confrontation at their shared home.

Phypers noted that his ex-wife indeed had him sign adoption papers for their daughter, but she refused to take the crucial step of filing them. The consequence of her failure to file his signed papers may mean he cannot legally claim Eloise as his daughter.

The actress’ estranged husband added that his bond of over nine years with Eloise now stands at risk of being completely severed due to the separation between them. According to him:

“This has caused immeasurable harm and demonstrates the imbalance [Denise] maintains in this matter.”

Per PEOPLE, the former TV star adopted her daughter in 2016 and previously affirmed that her now estranged husband legally adopted Eloise in 2019, a year after they got married.

Before Phypers broke his silence on the ongoing flaw in Eloise’s adoption, his ex-wife had written to a judge to order his removal from their shared home for a few hours.

As reported by The Blast, Richards explained that her reason for the request is to ensure a swift removal of her belongings from their former home and so she can get her dogs, clothing, and her late mother’s properties. 

She added that the landlord for the property called her to ask that rent be paid on the Calabasas property, despite her stopping payments in January after Aaron and his family refused to exit the properties.

The TV star noted that the landlord left her a message in July that she must vacate the premises by August, which has now left her no choice but to get her things from the property to prevent any of her property from getting damaged. 

Phypers’ legal team is fighting back, describing her move as a ploy to shift public attention away from her cheating scandal. His attorney continued that while she attempted to renew her image, her team wants to use the frequency medicine practitioner as collateral damage. 

Phyper’s legal team questioned why Richards would choose to go to the home of someone she claimed was after his life without prior notice. Fans also have a lot to say about the new development, with some wondering why he would move into a house serviced by Richards with his family.

Other commenters described it as a money-grabbing move from the Phypers, noting that he is merely looking for a way out financially within the short term.

Some fans accused Phypers of aiming for a love he cannot finance; they used this as a point to subtly justify why the TV star stepped out on her husband.

Before asking for his exit from their home, Richards had gone to court with a previous request that he return all her personal belongings in his care. The Blast explained that she claimed that her estranged husband’s continuous access to her phones, laptops, and other recordings put her in harm’s way.

She then asked that the court obstruct him from sharing any more content on these devices, as he had already allegedly begun leaking her private information to news outlets.

Richards explained that she stumbled upon pictures of her breasts and buttocks completely exposed in a story released by a media outlet. She also recalled spotting Phypers’ hand holding a phone containing images of her private text messages.

“I am in extreme distress and greatly disturbed since Aaron has been repeatedly disseminating private text messages stolen from my laptop after the TRO has been issued,” she noted.

Well, whatever secret Richards was trying to protect played a role in the breakdown of their marriage, maybe a fraction of those secrets. According to her estranged husband, he stumbled on several messages and exchanges between her and a lover she had been seeing for about two years now.

Phypers’ discovery of these raunchy texts and conversations left him reeling with betrayal and disappointment. He revealed that Richards even had plans to invite her lover into their marital home at the time.

He decided to confront her about this debilitating discovery after he realized his estranged wife had not desisted from her philandering ways in July. This new encounter happened nearly two years after Phypers initially caught his wife but decided to forgive her.

The fallout from Phypers’ latest revelation culminated in his decision to end the marriage on July 7th, 2025, three days after their big blowout.
